VIP Club – Terms & Conditions

1. Membership & Eligibility

The Waverly Bowl Inn VIP Club (“VIP Club” or the “Program”) is a free rewards and offers program operated by Waverly Bowl Inn (“Waverly Bowl Inn,” “we,” “us,” or “our”).

Membership is:

- Limited to individual, natural persons (no businesses or groups).

- Limited to one account per person.

- Available to individuals who are 18 years of age or older and legal residents of the United States.

The VIP Club is intended for personal, non-commercial use only. By enrolling in the VIP Club, you agree to these Terms & Conditions (the “Terms”). No purchase is necessary to join.

Any information we collect from you in connection with the VIP Club will be used in accordance with our general website and privacy practices as posted on waverlybowlinn.com.

2. Program Description

You may join the Waverly Bowl Inn VIP Club by completing a sign-up form:

- On our website at waverlybowlinn.com, or

- In person at Waverly Bowl Inn using our paper or digital sign-up methods, or

- Through any other enrollment method we may make available.

By joining, you agree that we may contact you with promotional and marketing messages based on your communication preferences, which may include email, SMS/text messaging, and/or other digital communication methods we offer from time to time.

Standard VIP Club Benefits

As a VIP Club member, you may receive:

- Welcome Offer – A special offer or discount just for joining the VIP Club.

- Birthday Offer – A special offer or discount during your birthday month.

- Anniversary Offer – An offer to celebrate the anniversary of your VIP Club enrollment.

- Local & Personalized Offers – Periodic offers, updates, and promotions related to bowling, arcade games, pizza, and drink specials (including soda and, where legally permitted, alcoholic beverages for guests 21+).

Specific offers, their amounts, and redemption rules may change over time at our discretion.

3. Earning & Receiving Rewards

From time to time, we may offer rewards based on:

- Your purchases at Waverly Bowl Inn,

- Your participation in special events or promotions, or

- Other qualifying activities described in our promotional materials.

If we offer a points-based system, details such as how points are earned, point value, and what they can be redeemed for will be posted on our website or in promotional materials. We may update or discontinue any points system at any time.

Unless explicitly stated:

- Rewards, including any points, have no cash value,

- Are non-transferable, and

- Cannot be sold, exchanged, or combined with another member’s rewards.

- You are solely responsible for any tax obligations related to rewards you receive, if applicable.

4. Redeeming Rewards

You can redeem eligible rewards in person at Waverly Bowl Inn by:

- Presenting your VIP Club information (such as your name, phone number, or email on file), and

- Informing staff you would like to apply a valid reward to your purchase.

Additional conditions may apply:

- Rewards may only be used on eligible items or services,

- Only one reward may be used per visit, unless otherwise stated,

- A reward may not be redeemable in the same transaction in which it was issued, and

- Alcohol-related offers are only available to guests 21 or older with valid identification and where allowed by law.

If applicable, any points or rewards used in a transaction will be deducted from your account at the time of redemption.

We may set expiration dates for specific rewards or for points (if applicable), which will be communicated in the offer details or on our website.

5. Inactivity & Expiration

If your VIP Club account shows no activity (such as redeeming an offer, earning a reward, or updating your account) for an extended period, we may:

- Deactivate your account, and/or

- Expire any unused rewards or points associated with your account.

The length of inactivity that triggers expiration or deactivation will be stated in our promotional materials or on our website and may be updated from time to time.

6. Changes, Suspension, or Termination of the Program

We reserve the right, at our sole discretion, to:

- Change, limit, or modify any aspect of the VIP Club,

- Adjust how rewards are earned, calculated, or redeemed,

- Modify or cancel specific offers, and

- Suspend or terminate the VIP Club in whole or in part.

We will post any material changes on waverlybowlinn.com or otherwise notify members using contact information on file. Your continued participation in the VIP Club after changes have been posted constitutes your acceptance of those changes.

7. Canceling Your Membership

You may cancel your VIP Club membership at any time by:

- Contacting us by phone at (319) 352-4724,

- Visiting Waverly Bowl Inn in person, or

- Using any opt-out method or contact form we make available on waverlybowlinn.com.

If you cancel your membership:

- You may stop receiving marketing communications associated with the VIP Club (subject to processing time), and

- Any unused rewards or points associated with your account may be forfeited and become void.

You may also opt out of certain communications (such as SMS) by following the opt-out instructions in the message itself.

8. Limitation of Liability & Release

By participating in the VIP Club, and to the fullest extent permitted by law, you agree to:

- Release and hold harmless Waverly Bowl Inn, its owners (including Zachary Beschorner), employees, and representatives from any claims or damages arising out of your participation in the Program, your use of rewards, or any program-related activity.

We are not responsible for:

- Lost, stolen, or misused rewards,

- Errors in communication or account information you provide, or

- Technical issues that affect the issuance, tracking, or redemption of rewards.

9. Governing Law & Disputes

These Terms and your participation in the VIP Club are governed by the laws of the State of Iowa, without regard to its conflict of law rules.

Any disputes arising out of or relating to the VIP Club or these Terms will be handled in accordance with the dispute resolution practices described on waverlybowlinn.com, and, where applicable, in the state or federal courts located in Iowa.
